Shouldn't it be a class action suit against the people who, for example, buy Apple products, many of whom know full-well where their products come from? Or how about the investors? Given a big chunk of industrial civilization in wealthy countries is built on devices with cobalt in them, much of which is mined in the DRC, shouldn't nearly every one of us be named as a defendant?
Not trying to troll here, more of a thought experiment about where the limit of liability should be drawn, and maybe wondering whether lawsuits like this are the appropriate mechanism to address this kind of issue.
